Section Description
This course covers the standard materials relating to the courtroom demonstration of facts in civil and criminal cases. Emphasis is placed upon the central concepts of “relevance” and “prejudice” and detailed consideration is given to the rule against hearsay and its exceptions. The course also treats problems of character, credibility and the impeachment of witnesses and privileges, as well as evidence from experts. Focus is on the Federal Rules of Evidence. The course employs the “problem method” more than the “case method.” The theme of the course is largely pragmatic; the rules of evidence are studied from the litigator’s perspective.
The exam is “objective,” i.e., true/false and multiple choice.
