Section Description
This course examines the use of the Federal Rules of Evidence in criminal and civil trials. Considerable time will be spent on the central concepts of "relevance" and "prejudice," and an extended treatment of the hearsay rule and its many exceptions will give the class practice in refining theories of evidentiary use and misuse. The interplay between the hearsay rule and the Constitution will also be examined. In addition, we will consider character evidence, the impeachment of witnesses, and the introduction of physical and expert evidence. There will also be an emphasis on the rulemaking process and the drafting of the Federal Rules.
In-class, open book exam, part multiple choice, part essay.
