

Before his September 2024 retirement from the active practice of law, Mark Lebovitch founded and led the corporate governance litigation practice at stockholder rights firm Bernstein Litowitz Berger & Grossmann. His practice focused on all aspects of the practice’s stockholder derivative suits and transactional litigation, with a focus on case assessment and identifying novel challenges to alleged anti-shareholder practices, as well as negotiating resolutions to the department's cases. Over his 25-year career, Mark brought claims that changed corporate governance practices, including challenges to anti-activism poison pills, dead hand proxy puts, and the way SPAC deals take place.
Since his retirement from active practice, Mark has been a guest lecturer at various prominent law schools, and co-taught the "Advanced Topics in Corporate Law" seminar with Vice Chancellor Will at the University of Pennsylvania Law School in the Spring of 2024.
Mark received various awards and recognitions for his work, including the New York Law Journal naming Mark the 2019 “Attorney of the Year,” being named a “Litigation Star” by Benchmark Litigation and the highest rankings from Chambers USA. Mark was the first plaintiff-side attorney to be named a Fellow at the American College of Governance Counsel, a prestigious and invite-only membership of experienced lawyers who have focused on the field of corporate governance.
