Section Description
This course is designed to complete the portions of a traditional Administrative Law course not covered in Legislation and Regulation. The topics covered include: (1) the constitutional provisions that potentially restrict adjudication by agencies, including Article III, the Appointments Clause, Presidential power of removal, and the right to trial by jury (Seventh Amendment); (2) the distinction between rulemaking and adjudication; (3) the APA provisions that govern formal agency adjudication; (4) the due process caselaw that governs informal agency adjudication; (5) statutory and nonstatutory review of agency action; (6) nonreviewable agency action; (7) standing to seek judicial review under Article III and the zone of interests doctrine; (8) exhaustion of administrative remedies; (9) the final action requirement; (10) the ripeness requirement; and (11) the primary jurisdiction doctrine.
